Chapter 61
Domestic Animals
61-1. Applicability of County Law.

All provisions and requirements of the Frederick County Code, Chapter 1-5, entitled Animals and Fowl (as amended from time-to-time) are hereby adopted, ratified and incorporated as fully as if set out at length herein, including, but not limited to, the provisions and requirements pertaining to: animals deemed a public nuisance, vicious dogs, licensing, vaccinations, impoundment, impoundment and redemption fees, poisoning of animals, enforcement, violations, penalties, and fines. Animal Control Officers as designated by the County Commissioners for Frederick County shall act as the enforcement authority for the animal control and dog licensing provisions of the Town, acting under the general supervision of the Frederick County Animal Control.  The Animal Control Officers are empowered to take into custody and turn over to Frederick County Animal Control, stray, injured, or sick animals in accordance with the provisions of Chapter 1-5 of the County Code. 

61-2. Control of Animals.

An animal shall be deemed as under the “immediate physical control” of its owner or keeper (as used in Chapter 1-5 of the County Code) if it is kept on a leash or chain, confined within a fence or barrier, or within a vehicle.

Frederick County, Maryland Code of Ordinances
§ 1-5-1.  DEFINITIONS.

     For the purpose of this chapter, the following words and phrases shall have the meanings respectively ascribed to therein by this section.

 AT LARGE. An animal shall be deemed to be at large whenever it is not on the owner’s property or under the immediate physical control of a responsible person capable of physically restraining the animal.

§ 1-5-24.  RUNNING AT LARGE.

     (A)     It shall be unlawful for an owner to allow any animal to run at large.

     (B)     The provisions of subsection (A) shall not apply to any dog which is accompanied by its owner and is being used for hunting or is being trained, exhibited or accompanied by its owner on horseback.

SNOW REMOVAL
 

All owners and persons in possession of any land or premises situated on any street, alley or highway within the limits of the town where sidewalks have been or may hereafter be laid shall remove the snow therefrom the entire length thereof to a width that will accommodate two (2) passing pedestrians within twelve (12) hours after snowfall has ceased. In the event the snow is not removed within the time and manner above provided, the owner or person in possession shall be liable to the fines and penalties hereinafter provided. In addition thereto, the town may cause the same to be removed as above specified and charge the cost thereof against the owner or occupant, to be recovered by civil process.

Violations and Penalties:
The violation of this chapter is declared to be a municipal infraction.
The penalty for violation shall be the sum of fifty dollars ($50). 
No warnings will be issued.
