Authorities and Responsibilities:

The Board of Appeals shall have the authority to:

  • Hear and decide appeals from any order, requirement, decision, action, or determination made by the Zoning Administrator.  The Board may reverse or affirm, wholly or partly, or may modify the order, requirement, decision or determination as ought to be made, and to that end shall have powers of the Zoning Administrator from whom the appeal is taken.  The Board of Appeals is only authorized to hear and decide on appeals of the Zoning Administrator and no other agency or body.
  • Authorize a variance from the terms of the Ordinance as provided in Section 2.3.1 of the Thurmont Zoning Ordinance.
  • Hear and decide Special Exceptions as authorized under Section 2.3.3 of the Thurmont Zoning Ordinance.
  • Interpret the boundaries of a zoning district upon referral by the Zoning Administrator.
  • Hear and decide approval requests for any non-conforming lots, structures, and uses.

Members must:

  • Be a resident of the town.
  • Complete the Board of Appeals Education Course online through the Maryland Department of Planning and receive a certificate of completion within six (6) months of being appointed.

Membership of the Board of Appeals consists of five (5) members and on (1) alternate member.  These members are appointed by the Board of Commissioners.  Members serve terms of three (3) years and must apply for re-appointment to the Board of Commissioners at the end of their respective terms.
